Terms & Conditions

These terms and conditions ("Terms") govern your access to and use of the SolidStrata website and the satellite ground stability reports and related services we provide ("Services"). By ordering a report, using our website, or contacting us to request the Services, you agree to be bound by these Terms. Please read them carefully.

Important: SolidStrata reports are informational and based on satellite (InSAR) analysis. They are not structural engineering surveys, building inspections, or legal certifications, and must not be relied upon as a substitute for professional advice from a qualified surveyor or engineer. See section 5 below.

1 Who we are

SolidStrata ("we", "us", "our") is a service operated by SolidStrata, with its principal place of business at Garies, South Africa. You can contact us at hello@solidstrata.com.

2 Definitions

  • "Report" means the ground stability report or dataset we prepare for a specified property or location.
  • "InSAR" means Interferometric Synthetic Aperture Radar, the satellite radar technique used to measure ground movement.
  • "You" / "Customer" means the person or organization ordering or using the Services.
  • "Property" means the address or location you ask us to analyze.

3 The Services

We use satellite radar data to estimate millimetre-scale vertical and horizontal ground movement at or near a Property over a historical period, and present our analysis in a Report. The scope, time period, and format of each Report are as described at the time of ordering or in a written quotation.

We may, at our discretion, decline to provide a Report for a particular Property where suitable satellite data is unavailable, insufficient, or where analysis is not technically feasible. In that case we will not charge you, or will refund any amount already paid for that Report.

4 Ordering, quotations and payment

  • An order is placed when you confirm your request and, where applicable, accept a quotation from us.
  • Prices, fees and any applicable taxes are as stated at the time of ordering. We may change our prices for future orders at any time.
  • Payment is due as set out in your quotation or order confirmation. We may withhold delivery of a Report until payment has been received in full.

5 Nature and limitations of Reports

You acknowledge and accept that:

  • A Report is an analytical estimate derived from remote satellite measurements and statistical processing. It describes apparent ground movement detected at or near the Property and does not directly measure the condition of any building or structure.
  • A Report is not a structural survey, building inspection, geotechnical investigation, valuation, or legal certification, and is not a substitute for inspection or advice from a qualified surveyor, structural engineer, or other professional.
  • InSAR results are subject to inherent limitations, including satellite revisit intervals, ground surface and vegetation conditions, atmospheric effects, and the availability and density of stable reflective points near the Property. Some properties or periods may yield limited or no usable data.
  • The absence of detected movement does not guarantee that a property is free from defects, and the presence of detected movement does not by itself indicate structural damage.

6 Data sources and accuracy

Our analysis is built on satellite radar data, including data from the European Space Agency (ESA) Copernicus / Sentinel program and other providers. While we apply industry-recognized processing methods and quality checks, we do not warrant that any Report is complete, error-free, or fit for any particular purpose, beyond the standard of reasonable skill and care.

7 Licence and intellectual property

All intellectual property rights in the website, our methods, and the Reports (excluding underlying third-party satellite data, which remains subject to its providers' licenses) belong to us or our licensors. Upon full payment, we grant you a non-exclusive, non-transferable license to use the Report for your own internal, personal, or business purposes in relation to the Property.

You may share a Report with your professional advisers, prospective purchasers, lenders, or insurers in connection with the relevant Property. You may not resell, sublicense, or commercially redistribute Reports, or remove any notices or attributions, without our prior written consent.

8 Acceptable use of the website

You agree not to misuse the website, including by attempting to gain unauthorized access, introducing malicious code, scraping content at scale, or using it in any unlawful way or in breach of these Terms.

9 Cancellations and refunds

Because Reports are produced specifically for you, an order generally cannot be cancelled once preparation has begun, and fees for a delivered Report are non-refundable except as required by applicable law. If we are unable to deliver a Report (see section 3), we will refund the amount you paid for it. Any other refunds are at our discretion.

10 Disclaimers and limitation of liability

To the fullest extent permitted by applicable law:

  • The Services and Reports are provided "as is" and "as available," and we disclaim all warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We are not liable for any loss arising from your reliance on a Report as if it were a structural, geotechnical, or legal assessment, or for decisions taken without appropriate professional advice.
  • We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, revenue, or anticipated savings, even if advised of the possibility of such damages.
  • Our total aggregate liability arising out of or relating to each Report, whether in contract, tort (including negligence), warranty, or otherwise, will not exceed the amount you paid us for that Report.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms excludes any liability that cannot be excluded under applicable law.

11 Third-party content and links

The website and Reports may incorporate or link to third-party data, mapping, or services. We are not responsible for the content, accuracy, or availability of third-party materials, which may be subject to their own terms.

12 Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

13 Changes to these Terms

We may update these Terms from time to time. The version in force is the one published on this page when you place your order. Material changes will be reflected by the "Last updated" date above.
